  1. A person who got asylum over 7months ago can he get a SS card now? What ID will he need?

    • He can get the SSN – he should have a work permit too, which should have come automatically if the asylum office granted his case (if he was in court, he has to take some additional steps). Take care, Jason

    • Really? Why do you wanna report a false claim? Is that your job? It sounds like you have personal issue with the person or you are just hating. In this forum we have never read someone trying to report somebody else. If his claim is false, it is their business and when they find out, they will pay for their actions. Why do you want to report someone? What would you gain? Do you work for Keep im mind you will never progress in life when you wanna harm someone knowing the consequences. You could go talk to them and make them understand they should not do that instead of trying to report them. If I was you I would go talk to them so they can stop that fraud. It is sad to see that we have people like you… 🙁

      • As a citizen or your staying here on any other status, you should feel responsibility to take care of country as much as you can. By complaining it helps to save the country’s integrity and system. If everyone thinks like you, how innocent people will be saved. If you encourage fraud by being calm, they might harm in other way to country by terrorism or any national security threat. Its not the way to complaining if it happens only to you. Dont expect to get gain in everything. Be helpful to country atleast by helping to the system. If someone already knew that they are committing fraud wontedly, how do you expect them make understand .To complain about truth, no need to have personal issues.

  4. Hi Jason. I am asylum pending applicant. I applied for ead renewal. I put credit card payment form. Then I got notification from bank $410 transaction by ucsis yesterday. But I saw they refunded it back today. What is the problem?

    • I do not know. Without a receipt number, you cannot check case status on line. Did you submit the form and all other documents properly? With the proper Alien number? Did you file too early (the earliest you can file is 180 days before the old card expires)? Maybe wait a bit to see whether you receive any type of notification, but if not, you will have to file again. Take care, Jason

  5. Hi Jason,

    I filed aylum in anahiem office in june.
    Completed my first interview in august.
    Then got second interview letter which was in jan
    I am still waiting for decision as they told me that they will mail me the decision

    My question
    1- Does people who get interviewed twice get approved.?
    2- How long it can take for the decision?
    3- Can you recommend me any letter format to ask about the decision from them?

    • 1 – I do not think they are any more or less likely to be approved than people who are interviewed once; at least I have not noticed a difference. 2 – It is not predictable. If you do not get a response soon, you can contact the Asylum Office and inquire about the case. 3 – Some offices have a form, if you go in person. Otherwise, you can just send an email and include your name, Alien number, date of birth, country, and date of interviews. Take care, Jason

  6. Dear Jason, thanks for the help you are offering us. I have a question. My husband’s case was expedited and approved in the Chicago office. Now he filed I730 form. It’s in the Nebraska office. If we want to expedite the case who do we connect with Chicago office or Nebraska center? Thanks in advance.

    • Whichever office sent the receipt – you can send them a letter with evidence requesting expedited processing. It may or may not work, but it should not hurt to try. Take care, Jason

  7. Hello Jason,
    i entered USA on F1 visa 4years ago. my visa is going to expire by next year. i have no luck to get any other valid visa status. so i would like to apply asylum. frankly i dont have any isusses, i just wanted status to live here. i have prepared story and evidences according to some knowledge about asylum. do you think i can clear the interview if i show credible fear and evidences?. can asylum officer know that my case not true?

    • I just recommend to you. If you have any not true story in your asylum case. Do not tell anyone include your family friends and everyone in the world. Also do not ask such as questions to any attorney

    • Obviously, I think this is a bad idea, and that you should look for other alternatives. If the asylum office finds that you are lying, you could go to jail. You could also be denied opportunities for other immigration benefits. I have seen both things happen, though they are not so common. You might talk to a lawyer to see if you can come up with a better idea. Take care, Jason

  8. Dear Jason,
    I would appreciate answering me the following questions:
    1- My case has been referred to an immigration court. The NTA indicates that the hearing will be done in April, but when I check the court automated system, it says the hearing is not scheduled. How can I know when exactly my hearing is scheduled?

    2- USCIS rejected my case stating that I have not presented a well-founded fear nor for the past neither for future. Is there a better chance to win the case in the court? Can I provide the judge with more evidence and additional details about my case that I have not discussed with the asylum officer? Thank you.

    • 1 – This is common. They are required to put a time and date on the NTA, so they are basically making up dates and then changing it later. You can get your new date by calling the 800-898-7180 number until it is updated. Also, they should send you a notice by mail (update your address with the court and DHS using form EOIR-33). 2 – Generally, I find it easier to win in court, but it depends on the case and the judge. You can present new evidence, but be careful to be consistent with what you already submitted or provide an explanation for any inconsistencies. Also, if you do not have a lawyer, you should try to get one, as that does make a difference in court. If you cannot afford a lawyer, I did a post about how to find a free lawyer on September 22, 2016. Take care, Jason

    I am applying for an EAD with $410 waiver.

    What if for some reason they dont approve my waiver and it will be too late re-apply and my current EAD will be expired?

    • Then you will have a gap in employment eligibility. Apply as early as you can (180 days before the old card expires is the soonest you can apply) and hopefully, if you get denied, you will have time to file again. Remember that as soon as you get the receipt for the I-765, your old EAD is extended by 180 days. Take care, Jason

          • The receipt should extend the old EAD card. If the fee waiver application is rejected, I am not sure that they will issue a receipt. I have not done a fee waiver in some time, and I do not remember, sorry, Jason

    • If you are talking about a US citizen petitioning for a sibling, you can see that if you Google “DOS Visa Bulletin”. It is something like 14 years, but may be longer depending on the country. Take care, Jason

  12. i am pending asylum applicant and I have just transferred my funds ($200,000) from my home country to USA . And it was bank to bank transfer. My question is do I have to report it to IRS. If yes then what form do I need to fill. I have tried everything H&R Block and all agent in my state but no one have answer for that. Some said that I have to pay tax on it. Where as my understanding is that I don’t have to because I didn’t earn it in USA and I am not green card holder or citizen. Secondly would I be able to change my status if my asylum is denied . Based on business I am going to buy.
    Hope you may have answer for that. I have inquire IRS by email but got no response yet.

    • Maybe you need to find a better accountant – someone should know the answer. I do not. As for getting your green card by buying a business, it may be possible, but you should talk to a lawyer before you try that. You need to know (1) Whether you can qualify for a GC; and (2) If you have to leave the US to get your GC, and if you leave, are you eligible to do that, get the GC, and return. You need to be very careful about this, and I would get the lawyer to describe the whole process, from where you are now, until you have the GC, and to do it in writing. Take care, Jason

    I had my interview in Chicago (no I’m in Indian) but last month I got my ead so I want to move to Texas becaus I find job there my question is does my case will move to Texas because I won’t to I heard Texas has the worst statices for dined also I want my case stay in Chicago so what do you think

    • If you already had the interview, Chicago will make the decision in your case unless a second interview is needed (which is pretty uncommon). You are required to file a change of address if you move (form AR-11, available at http://www.uscis.gov), and so you should do that, as you do not want to miss any mail they might send you.   14. Hi Jason,

    I filed for an asylum as a dependent to my spouse in August 2018. We had our asylum interview and our application has been referred to an Immigration judge.
    In the referral notice to my spouse, It was mentioned … BECAUSE YOUR SPOUSE AND CHILD WHO WERE LISTED ON YOUR ASYLUM APPLICATION AS DEPENDENTS DO NOT APPEAR DEPORTABLE OR REMOVABLE, WE ARE NOT PLACING THEM IN THE IMMIGRATION COURT PROCEEDINGS ALONG WITH YOU

    Meanwhile after the 150 day clock I applied for my EAD & SSN, but it was denied. The letter basically says, A review of my file does not indicate that I have filed a Form I-589. Therefore I am not eligible for employment authorization under the C8 category and Form I765 must be denied.

    Can you please help & guide me how can I get an EAD & SSN please?

    • It may be that since you were not referred to court, you have been separated from your spouse’s asylum case. If that is correct, you are not eligible for an EAD. It is a bit unusual, since usually, all the family members’ immigration status is the same, but it does not have to be. If you think this is wrong, you would have to contact the asylum office and maybe ask them to refer you to court with your spouse. Otherwise, if your spouse wins asylum, you would be eligible to benefit from form I-730 and get asylum yourself. As for the EAD, if you are not eligible, maybe you need to file your own asylum case, if you have one. The process is different, since you were previously a dependent – check the I-589 instructions. Basically, you will file at the local office. Take care, Jason

        I spoke to USCIS officer over the phone, he asked me to file Form I-120B to try another chance. I was not very sure, so thought should take your advice. Also please let me now is there any other medium of applying EAD

        • I do not know that form. Appeals are usually done on the I-290B, but I do not see how that will help here. If you are a no longer a dependent on the case, then USCIS made the correct decision (the purpose of an appeal is to show that USCIS made a mistake). I think you need to determine whether you are a dependent on the case. If so, maybe an appeal is appropriate. You have very limited time to appeal (maybe 30 days from the date of decision), so you should try to determine the answer – maybe talk to a lawyer. An alternative to appealing an I-765 denial is to file a new I-765 with evidence that you are still a dependent. That is cheaper and probably faster, but depending on the situation, an appeal may be more appropriate. Take care, Jason

  16. hello Jason,

    I am under my mom’s pending asylum case. Myself, Mom and sister applied for an EAD renewal and I was the only one to get it recently after a brief, barely 2 months wait. Since our case has been pending since November 2015, I’ve been wanting to apply for a travel permit to see my father who is at a country other than the one seeking asylum from. Do you think with the help of a lawyer I should be able to put in a successful travel permit application?

    • The wait times for EADs (and many other immigration benefits) are very unpredictable, so it is not surprising that different family members have different wait times. As for the travel, if you have a pending asylum case, you need Advance Parole. I wrote about that on September 11, 2017. Since that time, it has become harder to get – you need to show a humanitarian reason (often a health problem) and submit proof of the relationship, such as your birth certificate with your father’s name on it. Whether you use a lawyer is up to you. Take care, Jason

    I am an asylee. Got approved asylum status in 2018 now i want to apply for GC, my question is will it be adjustment of status and what will be the total fee i have to pay? I have to file for myself and for my 5year old child should i pay 2 separate check or together?

    • The fee for you is $1225 and the child pays a lower fee (check the form I-485 instructions – the fee is less if you are seeking a GC at the same time, and it is less anyway for a young child). You would file two complete applications – one per person, and you would each pay your fee (two separate checks). You can mail the two applications in the same envelope, preferably with a cover letter explaining that it is you and your child. By the way, if the fee is too much, you can request a fee waiver using form I-912. Take care, Jason

    I need your advice, I am a physician. My current status is asylum pending. I applied for asylum in Nov 2015 because of the very long delay in the asylum processing we are trying to find other way.

    I wanted to know if it is possible to apply for adjustment of status from my asylum application application to Physician National Interset waiver program?
    I do not wanna go back to my country to get a work visa from the American consulate over there because of the safety matter. I can get a job offer in a hospital in underserved area.

    • Maybe, but I imagine you would need to leave the United States and get your GC at an embassy overseas. This may or may not be possible. Talk to a lawyer about that. Also, I wrote something relevant on August 28, 2018 – maybe that would help. Take care, Jason

  19. Hello Jason, Im from Libya and Im fleeing prosecution by militias some of which aligned with the government because of my political activities and affiliation. My case is strong and the evidence is very clear. During my asylum interview the officer wanted to know how often I encountered armed groups and I said very often coz they control check points in Tripoli. The officer asked what they ask for and I said normally they ask for car registration and information like where are you going and where you were. The officer wanted to know if I ever was part of an armed group or assisted any armed group and my answer was very clear “NO”. In fact, I was insulted twice at check points by armed groups and I told this to the officer. So do you think that just encountring armed groups in check points could delay my case as a result of TRIG ? How do I know if my case is delyed because of TRIG? I heard the waiting time for this is indefinite? I have big fear. It’s important to know if my case might face such a bar because I can try to go to Canada where they don’t have such a policy. Did you work on similar cases from Libya? Iraq? Syria? Afghanistan? What is the outcome?

    • The officers often want to know if a person has passed through a check point, and whether they have paid any money (even a small amount) to pass through. If so, you could face a TRIG bar. If you never gave anything to the people at the checkpoint, and the officer believes that, TRIG should not apply. There is probably no way to know what the officer thinks about this unless you can get an idea from what happened at the interview, but if the delay gets to be long, that could be the reason. In general, men from Muslim countries wait longer than others for the security check, so any delay could be related to that as well. Whether you are better off going to Canada, I do not know, but if you try that, I would talk to a lawyer in Canada before you go, to get a sense about how the US case might affect any case up there.     Hope you are doing well.

    It has been almost 11 months since I had my asylum interview in the Chicago office, still waiting for a decision. First time I inquired about my case, I was told that 1. my case is still pending and 2. I can request an expedited decision if I have a reason to. The second time I inquired about my case which was very recently I was told that my case is still pending but nothing was mentioned about requesting an expedited decision. Does this have any meaning? Do you think I should expect a decision soon? It will be one year since I interviewed in April 2019.

    • I think it has no meaning. If you have reason to request an expedited decision, you can try that. You could also potentially file a mandamus lawsuit – we wrote about that on October 2, 2018. Otherwise, you can wait. Most people get a decision in less than a year, but there is no way to predict; many people wait longer. Take care, Jason

    My husband studied here in the US 15 years ago and went back to our country. I came to the USA and applied for asylum 4 years ago and am still waiting to be called for interview. Can I fill my husband in my Tax claim who is not in the US currently using the SSN number he got while he was student? Will it have any negative effect on my case .

    In the filing instructions of form I765 it says that one of the required documents is copy of the form I-94.
    I don’t have that. In my passport there is only a stamp of entry to the U.S.A. There is no I-94 attached
    to my passport. What should I send them in that case? Should I send them the copy of the page of my passport with the entry stamp/

  24. Hello mr. Jason , please respond as I am really terrified at the moment.
    I recieved an NTA in my mail on Feb 5th (three weeks ago). On the NTA , the date for my MCH was March 20th, 2019 at 1 pm , in Miami Immigration Court.
    (I was shocked that the MCH was not even 2 months away from the date I received the NTA.) I immediately the same day, checked the Immigration court automated number ,but the machine answered that my case have not been filed with the court.
    I kept calling the number every day after that and it was saying the same (your case has not been filed with IC.
    However, when I checked today, my case has been filed, the machine correctly spelled my name, and inform me that my MCH is on October 24, 2019 in Miami, at 8 a.m and before Judge Anthony.

    So now I am confused, which one is correct?
    The date and time on the actual NTA or the one that is when I call the automated machine?

    Please advise me how to proceed with this and what is your thoughts or experience with this situations?

    • This is a common situation – the government is required to put a date and time on the NTA. Otherwise, it is invalid. However, they do not have actual court dates available, so they put a false date on the NTA, and then later schedule a real date. The date on the phone system should be correct, and you (or your lawyer) should receive a written notice in the mail. If you do not receive that notice, contact the court directly or go in person to ask – you can find their contact info if you follow the link at right called Immigration Court. Take care, Jason

  25. Hi Jason,

    I am in removal proceeding and my individual hearing is on the coming May for the asylum. Two years ago, I got married and my husband’s I 130 petitions was approved. Since my I 485 form is administratively closed due to USCIS does not have jurisdiction on it, I filed termination. But DHS oppose the motion to terminate and the judge still did not give any decision yet. I need your advice on those two questions based on the above scenario, please.
    1, is that good to request the judge to get a decision based on my marriage on my individual hearing date??? And what is the merit and demerit of it??
    2, since I am proceeding with the marriage, is EOIR defensive asylum biometric still need to be done before the court?

    • 1 – You can present the I-485 to the judge and if it is successful, the judge can grant you your residency. Whether you are eligible for that, I do not know, and you should definitely check with a lawyer to be sure, as there is no sense in presenting a case that you are ineligible for. If it works, it is about the same as getting the green card with USCIS, though there is an additional step after the judge issues the order for you to get the actual card. 2 – You should do the biometrics for asylum and you may also need to do them for the I-485. Given that DHS is opposing for some reason, I highly recommend you talk to a lawyer to make sure there are no issues blocking the marriage-based case. Take care, Jason

    I have informed that my individual court hearing is through video conference ; is this common for non- detained legal Asylum seekers? Does it has any implication ?

    • Maybe it is common in some courts, but I have only seen that for detained cases, as best as I can remember. I think it is not a good thing, as it is easier to present the case if everyone is in the same room. If you have a lawyer, you could potentially try to challenge the video hearing and ask for an in-person, but I do not know whether that will work. It would be worth objecting to the video hearing, so that if you do lose, you will be able to raise that issue on appeal. Overall, though, you should be able to present your case even if it is by video, so it is not a disaster; it is just preferable to be in person. Take care, Jason

    I red an article of you saying that immagration gives hard time for asylee siblings sometimes…
    Is there a reason to worry that they won’t let him in ?

    • Normally, siblings have less trouble than spouses, so probably it will be fine. Maybe he should be prepared to explain why he will return, if asked – for example, if he has a return ticket, he should keep a copy of that. Also, if he has a job, family, property, etc. back home, maybe he should have access to evidence about that (he can scan it and keep it on his phone, for example). Then if asked, he can present the evidence. Most likely, he will have no problem, but there is no harm in being prepared. Take care, Jason

    Since we can check online the case status of asylum applications, last month when I checked it says “decision pending”. Now recently I have received a case status update email stating “initial review” and when I logged in and checked it shows me the number of days pending around 1570 days and says application is pending.

    I don’t understand what it means, have they started reviewing our case for a decision and in such a situation how long it takes for USCIS to have a decision on our case . Our interview was held in August 2017.

    • Unfortunately, they have not published a list of all the possible messages or any explanation, other than what is contained in the message. So I really do not know why the message changed. I suspect that it has no meaning, but that could be wrong. Maybe you want to contact the asylum office directly to ask about your case, as it has been quite a while.     I came to the US on a student visa but I don’t have student status anymore. Do I still need to put my Sevis number there?

    • If you no longer have a number, you should not list it. You might include a cover letter explaining that you had a SEVIS number (and listing the number) but that it is no longer valid, just so everything is clear. Take care, Jason

    I just checked my EAD Renewal application status online and it says “ we completed our review of your fingerprints and are working on your Form I-765, Application for Employment Authorization “.     • I don’t put much stock in the online messages. It seems like a normal message to me, and it seems like they are processing your case. We are seeing renewals take 4 to 7 months, so you may have some more time to wait. Take care, Jason

    • You can make two complete packets including all required documents, and then you can send them in the same envelope, but it should be clear that they are two separate applications. Each person should have a check for $410. Take care, Jason

    I have a question. In filling out the I-765 form is it mandatory to write N/A or None
    in place I don’t have an answer (for example it says “other names used”). If I don’t
    have other names can I just leave it a blank or I have to write N/A.

    • You can leave it blank, but it might be safer to write N/A – once we had an asylum form rejected where we left the siblings part blank. The guy had no siblings, but they rejected it. Since then, we try to write N/A. Take care, Jason

    I am waiting for my interview with due EAD renewal in july. Me and my husband applied for asylum. My younger daughter (2yrs) is us citizen. My elder daughter (4 yrs) was in my home country who recently came here with us on B1/B2. Her I 94 is going to expire soon in March 2019.
    Here i want to ask whether we can add her name in our application simultaneously with our ead renewal? Can adding her name affect ead renewal process or interview?
    Is it possible adding her name at this time of EAD renewal brings the case to the immigration/for interview faster?
    Is it wise to add her in the application in between or should we wait for interview and to add that time ?
    till that she just stay with us after expiring her b1b2 status. and she will be without status.

    Please suggest what to do best.

    • Adding her to the case will not affect your EAD process. It is safer to add her to your case. Contact the local asylum office about how to do that – you can find their contact info if you follow the link at right called Asylum Office Locator. If you do not add her to the case, she could technically be detained and deported once she is out of status. This is very unlikely, given her young age and your asylum case, but if you add her to the case (which can be a pain, but will eventually work), you will not have to worry about it. Take care, Jason

  35. Jason, I was browsing some forums to check on people’s EAD processing time experience.

    It looks like most people are waiting for EAD renewals roughtly for 270-300 days!!!

    What is the best way to expedite EAD renewal? Involve senators or just file for expidite? I am concerned that I might lose my job if it takes to long.

    Does National Benefit Center handle EAD renewals?

    • Once you file to renew, you get an automatic 180-day extension of the old card. You can also file to renew 180 days before the old EAD expires, so there should be enough time. In terms of expediting an EAD, it is not easy. The only thing to do is to contact USCIS (www.uscis.gov) and ask – either by phone or in person through Info Pass. Typically, though, it is better to file early and with the automatic extension, you should be fine. Take care, Jason

    I recently got paroled into the US with the AP i got through TPS. Travelled to a third country.

    I currently have my asylum decision pending. Done with the interview but no decision yet.

    My husbands employer is filing for his i485 . Will i be able to file my i485 along with him ?

    • Normally, a dependent can get the green card with the principal applicant for an employment-based visa. You should talk to your husband’s lawyer. Also, depending on your immigration status, you may or may not be eligible to adjust status in the US – presumably, your husband is eligible since they filed the I-485.     I’m from syria and I’m under TPS and my asylum is still pending. Can I apply for travel document to go see my parents in a third country. If they approved my travel document, is there any issues with that of traveling outside to a third country to meet them.

    • I think you can get Advance Parole based on TPS or asylum. For asylum, you need a humanitarian reason (and maybe for TPS as well). This used to be a formality, but they have been more strict about it lately. I wrote about AP on September 11, 2017, but if you have the AP document, you should be fine to travel and return.     Hope you are doing well. I have a question. I am an asylee who is still waiting for his interview. I want to know when should I apply for the renewal of my and my family’s EAD’s. How long before the expiration date can I apply? I also want to know that do I have to pay the same amount for my small kids’ EAD’s as well or it’s different fee? Besides the form I765 do I file in other documents or no?

    • If you don’t have a special reason and they already have SSN. You don’t need to reneval ead for kids. Basically just waste money.

    • You can apply up to 180 days before the old card expires. The fee is the same for children and adults, but since young children normally do not need an EAD, most people do not bother to renew their cards. As for the I-765, you have to file it with all the supporting documents you filed before (check the instructions to the form). Also, if you were ever arrested, you need to submit evidence about that (again, check the instructions or see a lawyer if this is your situation). Also, you need a copy of the expiring EAD – front and back. Take care, Jason

    1. How early can Asylee file for AOS (sending the packet to USCIS) ?
    2. Can we travel outside the country with RTD while the AOS is pending (After getting the receipt) ?

    • 1 – We send it one year after asylum was granted. Not a day sooner, as USCIS could reject it. We used to send it 30 days early and that worked, until USCIS rejected one case and since then, we have waited the full year. 2 – Yes, as long as you are in the US for biometrics and any interview, that should be ok.     What next now for my green card files do i need another appointment for fingerprint or just one who i did already ?

    • You should have a fingerprint appointment for the green card. Some people get interviewed for the GC; others do not. If you were a principal asylum applicant (as opposed to a dependent), you probably will not be interviewed, but you cannot really predict that. Take care, Jason

  42. Hello Jason,I have been interviewed but I still didn’t receive my asylum decision. Can I travel within the U.S from California to Vegas and then back to California by airplane? I don’t have a driving license so I will need to use my passport from my home country. Is that risky? What is the worst thing that could happen to me?

    • If you have work authorization you can get ID in one day.

    • It should be fine, especially if you have the EAD, but you need to check with the airline about whether they will accept the passport if your visa is expired. Bring proof the pending asylum case (receipts, biometric notice, EAD). You should get an EAD, as then you will have proof of your permission to be in the US. As for worst case, it is difficult to say, but if you have proof of your pending case, nothing should happen. The issue would be if the CBP officers do not understand the documents you present or see an expired visa with nothing else. Take care, Jason

    I came to USA in 2011 since then I never visit to my home country. I applied for Asylum and its approved past June 2018.
    Myself (Principle Applicant), wife and one kid are in my case. My two kids born in here.
    My question is since i never visit to my home country where I have fear and on that bases I won Asylum, Can I visit for few days with my refugee travel document just to look at my parents leaving my wife and 3 kids stay in USA.

    • First of all. You can’t visit to your country unless you are citizenship of us. Another thing if your country government learn you have refuge travel document, you may go to court and jail. Also as I know you are not suppose to use your passport while you are refuge. Ucsis may denied your citizenship if you use your passport. Finally all are my opinion according to some news and friends. My suggestion is just get your green card and try to get your family here. After a long time nobody wants to get risk

    • If you do that, you risk problems with your immigration status. You could lose your asylum status. You could be detained at the airport when you return. These events are probably not very likely, but they are real risks. You would be far safer to meet your parents in a third country. Whether you actually have a problem, and the end result, will depend on the case, but the worse case would be that you would be deported from the US. So I would look for other options before you try this. Take care, Jason

  46. Jason, I was expecting my individual hearing this April. This week I received a letter saying that the judge has rescheduled my hearing to February of 2020.

    It seems the judge has some medical problems and needs to see a doctor during that time.

    I have already been waiting for 4 years and don’t want to waste another year to wait for my individual hearing.

    What are my options to expedite my individual hearing?

    I have applied to renew my EAD in December of 2018.

    On USCIS website it says that they received my application on 12/11/2018 . Since then there is no movement.

    Compared to previous times when I renewed it, this time it is taking longer.

    Do you think there might be anything wrong in my process?

    • I doubt it. Renewals seem to be slow. We re seeing some that take 6 or 7 months. You do have the automatic extension for 6 months, so hopefully that helps. Take care, Jason

        • If you are asylum pending, and the EAD expires, you become ineligible to work legally. Once you file the I-765 and get the receipt, you get an automatic extension of the old EAD, so file as soon as possible.     I would like to ask for your opinion. Me and my husband (who is waiting for his asylum interview in the last 3,5 years) got married in august, 2018. He added me to his papers in august (I only had tourist visa at that time), but they lost my papers in the miami office, so i applied again in october (and I only got back a stamped Statement document (where my husband admitted that we got married) from October). I got my finger print scan in January, 2019 where they gave me another stamped paper and now I want to have a work permit.
    My questions are:
    When can I apply for my work permit,
    which form should I fill
    and did my status changed (or if they asking my status I am still with a working visa)?

    • If you have been added to the case and your husband has his work permit, you are eligible to file. Form I-765, available at http://www.uscis.gov). Your status is not asylum pending, which is not really a status, but that’s what you have. Take care, Jason

    My new lawyer(1st lawyer) told me that he will do adjustments in my i589(i prepared and sent it)and we going to re wright my story(it’s going to be the same story but in different wordss and etc.). Is it a normal thing for lawyers to do?
