  4. 1- regarding (FGM) , Mother had ( FGM back home country and she afraid that about her daughter. should the asylum application under the mother name or the daughter name because the daughter is 9 years old. who is the principle of the application.

2- can a green card holder married someone entered the states with visitor visa and both stay in U.S till her immigration documents finished or she must go back and finish the process from her back home country.
    Thanks

    • 1 – The child could potentially have her own case, but she could not include the mother in that case. The more normal approach would be to have the mother file for asylum and include the child in the case. Cases where a parent fears FGM for a child can be difficult to win, and the law is not the same across the entire US (different federal courts with jurisdiction over different parts of the US have reached different conclusions on this). You would do well to talk to an attorney to help you present the best possible case. 2 – If you come to the US and marry a person with a GC, you could potentially get your GC inside the US, but you would have to remain lawfully in status (maybe on an F-1 visa or an H1b visa) the entire time. A pending asylum case does not count for being “in status” for this purpose. Take care, Jason
