Without a valid EAD, you are not allowed to work. However, if you work without permission, it has no effect on your asylum case.

Can I work with expired one and just consider the notice of action as document to prove that my new EAD is under processing?

There have been a lot of delays with EADs lately. Under the law, you are not allowed to work without the EAD. However, if you do work without the EAD, it should not affect your asylum case. Take care, Jason

Thx, hope to see you as well. Just to be clear, i said some illegal aliens are violent criminals, not asylum seekers (though some may be). I don’t think many people are interested in the “human beings” behind the labels “rapist” or “violent criminal” if those labels are accurate- I surely am not – I want to be protected from them! I also don’t think Trump singled out asylum seekers, but referred to people entering the US illegally and with criminal backgrounds/intentions. I know it’s complex, I just don’t think when someone says “illegal alien” we should immediately narrow it into a straw man implying the term refers to legitimate asylum applicants who, as you know, are legally present in the US until their claims are fully adjudicated (which takes WAY too long…..we can agree on THAT!) Our refugee clients are in a class by themselves and I always strive to differentiate them from bad actors who drag down the cause if legitimate immigration. Just my perspective.

Many of our clients have long delays after the interview. Usually this seems to be for security checks. There is no way to predict how long the delay will be, but most of our cases are decided within one year, and only a very few have been waiting more than two years. Hopefully, you will get good news soon.

I don’t think I am the one who did the lumping together. My point is that when anyone (in this example I used Mr. Trump since he is currently in the spotlight) labels a group of people as “illegal” or “rapists,” it is a way to avoid real discussion about the human beings behind the label. Of course some asylum seekers are bad people, but (as I know you agree) that does not justify scape goating or fear mongering. As usual, I appreciate the comment, though, and I hope you are well (and maybe if the asylum office starts doing some cases, I’ll get to see you there again one day!).
