    • I have done cases in NY, but I have never tried to expedite a case there. We can certainly try if he wants. However, in NY or wherever, there is limited things we can do. I posted about this on February 26, 2015. Anyway, he is welcome to contact me.

  2. Hi Jason,
I have been reading your blog and it is very helpful. I have a question . my husband applied for asylum ( he is syrian on tps status) before we got married . He is still waiting for the interview . I am in the US since 8 months and I am on L1 A visa. can he add my name to his asylum application and would that affect my L1 A visa status ? also do you know how much time is the wait to get an interview in chicago office (he did his finger prints in July2014).
    Thank you for your reply

    • The time line in Chicago seems slower than in Virginia, and here they are currently interviewing cases from about June 2013. You can join your husband’s case – you can contact the asylum office for details about how to do that. It should not affect your L1 visa, but that is something you ought to check with a lawyer first if it is a big concern.

      • Thank you for your prompt reply, my husband is working with a lawyer and he concurred that it shouldn’t affect my status. There’s one more detail that I wanted to inquire about. Let’s say that I get my name on the application as a dependent and i get my biometrics scanned in, then for one reason or another I lose my L1A status (involuntarily) do I get a stay of Removal or will I be deported, and if so how is that feasible when I will need to show up to the interview with the principal applicant.
P.S: I’m not Syrian, I’m not sure if having a different nationality than the applicant works against us.

        Reply
        • Generally, having a different nationality should not matter. Also, if you lose your L1 status, you will be able to stay in the US as a dependent in an asylum case.

  4. Hello Jason
I am Gurjit Singh I have applied for political asylum in USA in Nov 2014 in Newyork asylum office I have given my fingerprints but did not get any response regarding interview.I belong to India and my family is back in India. Both my parents are 65+ and I am married and I have 3.5 year old daughter. My wife is going into depression and my parents are not able to take care of my wife and daughter because of their age factor.Earlier my sister was taking care of my family and my daughter but 4 months ago she got married and despite her doing best she cannot give enough time and care to my family and besides her newly married life is getting affected because of this.So considering all these factors I was planning to go back as soon as possible but my family donot want me to go back to India as they are scared for my life.I was very confused but luckily I got access to your website and this blog so I was wondering if I could apply for expedite case and I would like to have your guidance.

  5. Hi Jason,

I have a question. Would my asylum case be sent to immigration court without initial interview? I have applied after one year due to certain circumstances and obstacles.

    Reply
    • You should receive an interview, though the case can be denied if you have not filed within one year and you do not meet an exception to the one-year rule.

      Reply
      • I didn’t apply within one year but still waiting for the interview. Does it mean that I met the exception? I have received the letter from U.S. senator who have sent inquiry on my behalf. in the letter it says that my case is in background check process.

        Thank you.

        Reply
        • I am not sure I understand your question. If you did not file for asylum within one year of your arrival, your case will be denied unless you meet an exception to the rule. The delay at the asylum office has nothing to do with that.

          • I have applied after one year time frame by stating reasons and i am waiting for interview almost 2 years. I was wondering, will my case be interviewed or asylum office will send it to immigration court? I have received a mail from U.S. Senator who inquired status request on my behalf. In letter it says that my case is in background check process. My question. Will asylum office interview me or could send my case directly to immigration court? What do you think?

          • They should interview you. However, if they determine that you do not qualify for an exception to the one-year filing requirement, they will refer your case to Immigration Court. If they determine that you do qualify for an exception, they will review the merits of your case to see whether you qualify for asylum. The one-year bar can be difficult, and you may want to talk to an attorney to see whether there is anything that can be done to help you. Good luck, Jason

  6. hey Jason please don’t delete. Just want to say to all victims of backlog. I am waiting for interview year and 9 month. Now those nazzi animals from DHS are giving us hard time in getting work permit in a timely manner. It is an avid and direct torture. We gotta be tough. Its like test for mental toughness. They gonna torture us until someone commit a suicide. How come in Germany with over 200 000 cases latest case is being taken care within 18 month. Here in this gestapo with only 73 000 cases on the track it could take plus minus 3 years? Because, for them we are expendable material. people with no rights who will cope any humiliation. Jason if you will delete it. It means you are against the truth. You know very well that I am not lying. DHS USCIS start to run background check after approximately 18 month, knowing that it could take another 18 month to check it out. Plus unforeseen delays. I am telling you they are animals they are not human beings. I have complained in everywhere. No one gives a damn trust me. Here is the probably only place where I can write a truth if Jason won’t delete it. They are supposed to run background check right away. But, no they will torture us till the end. That’s is how after world war 2 americans brought lots of ss gestapo officials to the U.S. so they can escape justice and help to establish gestapo ss abver type of government over here.

    • I am not going to delete your post. I think you are writing out of very understandable frustration, which many of my clients (and I myself) share. However, I obviously do not agree with your statements about DHS, and I suspect that upon reflection, you might not feel quite that way either. In any case, my posting of March 31, 2015 discusses work permit delays, so maybe that would be of some use to you.

  7. Hi Jason. My name is Dima. I am from Russia.Thank you for your help. I am waiting for asylum interview. It will be 150 days on 04/23/15 after accepted case. My expiration date will 04/10/2015. Is it legal to stay in USA after expiration date? May I travel to Europe (not to Russia of course)? Thank you again.

    • Do you mean that your I-94 will expire on April 10? If so, that does not matter. Once you file for asylum, you can remain here until your case is done. As for travel, it is possible, but problematic. I wrote a post about that here: http://www.asylumist.com/2015/01/27/uscis-errors-compound-asylum-applicant-woes/

      • legally I can stay in USA only 6 months (B2 visa). I have notice in my travel passport and also in I-94 form about expiration date. what document USCIS should give me? Right now I have a letter that they received my case and a letter from fingerprinting. I had passed driving test but Dmv officer told me that the expiration date in I-94 to close. I told him that I am on asylum case. he told me that the computer program stops him and I can not receive the driver license. What document USCIS should give me for confirm my status? Thank you Jason.

        • With asylum, the only documents you get are the receipt and the fingerprint notice. After 150 days, you can apply for a work permit. In my experience, most DMVs will not give a driver’s license unless the person has a work permit. However, you should probably contact your state DMV to see whether there is anything else you can do.

  8. I had filed to renew my EAD (based on a pending asylum since 2013) on the 18 of NOV 2014, I received the receipt notice dated 11/24/14, and after 84 days, I submitted a service request, only for the case to be assigned to be an officer, I called back after two weeks, to hear that I have to wait for another 35 days before I inquire again. Is there anything else I can do? I have lost my job as the old EAD expired on 2.18.2015.

I have requested them expedite interview so many times hence I have family backhome. Based on information you have , When do you think they will call me for an interview ? Recently I heard that they are now interviewing backlog cases. Is this information true? I appreciate your your concern.

  12. Hi Mr. Dzubow, I’m waiting for my interview for political asylum in Los Angeles, case sent on january 6 and fingerprinted january 15. I got a strong case with proof and documents and i already talked with my lawyer this question but i really need a second opinion.

My husband had to escape from venezuela after i applied for political asylum in USA to be safe after persecution. Now he is in spain waiting for my process and eventually his derivative asylum as my husband, but he can only stay 3 months in spain, after this time he will be illegal there, so he is thinking to apply for political asylum in Spain in order to be legal while he still waiting for my process here wich is going to take long time as i can see… What are The risk If spain grant his asylum before my case is solved here? Can they deny my asylum here because i Will be able to obtain derivative asylum in spain. Otherwise What happen If I grant asylum here , can USCIS deny his derivative asylum because he already had asylum in spain before?
My lawyer says that there is no problem at all, but i read USCIS can deny or revoque political asylum If the person obtain help or asylum from another country.

    Im really worried about this.
    Thanks beforehand.

    • Thank you. The best advice I can give is to speak to an attorney about your case. In order to properly prepare a case, you need to gather evidence that is appropriate to your specific circumstances. In general, if you say something happened, you should try to get some evidence about that. However, it is worthwhile to at least consult with an attorney about your specific case.

      • Also, I would like to ask. Can you provide information about backlogged cases for each fiscal year? Like, How many pending cases are from 2013 and 2014 out of total amount of backlogged cases respectively? statistical data. Last time I red, USCIS had 28000 cases from 2013 only. I am wondering how many they have for 2013 as of now?

I have an approved I 130, my brother (USA citizen) applied it 5 years ago and I have letter from ins that I have to wait before my approved I 130 will be sent to the embassy. The question is :
can I go a head and apply for asylum in USA and then if status would not be granted, wait in USA (may be another 5 years)?
Do I have to leave USA or I can just adjust my status?
    Thank you for your help.

    Reply
    • If you are currently in the US, you can apply for asylum. The question about whether you could obtain your green card based on your brother is not so easy to answer, as it depends on different factors. My guess is that that would not work without leaving the US at some point, but you need to talk to a lawyer about the specific situation.

    • I do not know whether your office has a “short list,” but it probably does. You should ask the office about that. The policy has recently changed, and now USCIS will start reviewing older cases first (before, they were trying to review newer cases first with the idea that they would return to the older cases later). I believe this policy applies to all asylum offices. If this is correct, you will still have to wait, as the oldest cases are from 2013 and your case was filed in 2014. The reason you give about your education may be a basis to expedite. It may or may not work, but you can give it a try. Good luck, Jason

It sounds like the 90 days may have passed. In that case, I do not know what you can do except wait. The local offices should help, but it seems – as you learned – that they do not. There have been a lot of delays with the Employment Documents, and it is a real problem. I wish I had something better to tell you. Hopefully you will get the new work permit soon – Good luck, Jason

I’m just afraid if I do so, it’s going to play down my asylum case, plus I’m not seeing the benfite from waiting other 90th working day and pay approximately 700$ to have the TPS , when I could have the EAD next month ..

Honestly, I’dont know what to do ..but I sort it this way
I will apply for the EAD next month, and if nothing showing up in my asylum case before the 45 days from the TPS expired, I’ll apply to the TPS too..

    • You can change the address by giving the asylum office a form AR-11. They should send your mail to the new address. Please note that if you move to another location, it may cause the case to be transferred to a different asylum office, which might cause more delay.

    • Unfortunately the cases are often moving very slowly. You cannot work until you receive a work permit – which happens either when your case is granted or if there is no decision, 150 days after you file, you can apply (using form I-765). If you do work without permission, however, there is no penalty. You may want to contact one of the immigration charities (like Catholic Charities or Lutheran Immigrant and Refugee Services) to see whether they can refer you to people who can help you while you wait. To go to school, you can talk to the specific school for more info, and I see no reason why you can’t buy property. You may need advice how to do some of these things, but your immigration status should not prevent you from doing them.

  27. Dear Mr.Dzubow,

Since May 22 Royal Thai army state a Coup that throw out elected government, they put Martial law in place ever since. Hundreds of people has summoned, detained, torture, and prior to release forced to sign a “release agreement” said they will never resist the Junta government and travel out side of the country is prohibited.

In the mean time I found a Facebook page called “Reading as Resistance”, which schedule an reading activities to protest the Coup and to state that we don’t want Junta government. The activities take place in public area such as shopping mall, coffee shop, sky train, etc. On Sunday June 1st, I went out and read Gorge Orwell 1984 at a shopping mall. On Sunday June 8th, I did it again in a Mc.Donald coffee shop Ratchprasong intersection, on this day a lot of plain cloth police, uniform police, military officer are in place, taking photo of every person in the coffee shop.

On Sunday June 22nd, I heard that a man who read Gorge Orwell 1984 in front of a shopping mall, alone, was arrested ( Video has been posted on youtube here http://youtu.be/i9xTtkJXUzA ). I leave Thailand 3 days after, on June 25th, now I’m in Connecticut with my brother (he is on H1B status). At first I thought every thing will getting better soon, but it does not seem to be, more and more human right violation cases ( you may follow all these link http://bangkok.ohchr.org , http://www.amnesty.org/en/library/info/ASA39/011/2014/en , https://www.hrw.org/asia/thailand , and much more)

On October 19th, a man was arrested when he went back from attending a funeral just because the police have a picture of him attending a protest on May 28th, ( link here http://www.prachatai3.com/english/node/4420 ).

AS my B2-visiting status will be expire in December, and I don’t want to go back to Thailand as long as the Junta is still in power. I’m thinking of filing an asylum case, but I’m not so sure if my case is strong enough. My other option is applying for a university and have my status changed to F1-student VISA. Which path should I go? What is your opinion?

You are required to file for asylum within one year of your arrival in the US. There are some exceptions to that rule, but it is safer to file within a year. If you can afford to change to F-1, that would certainly give you more time in the US, and if things improve, you might be able to return safely. Potentially, you can change to F-1 and file for asylum, but this could create problems and if you choose this path, you should speak to a lawyer beforehand. Take care, Jason

  28. Hi Jason
    Greeting
recently I heard something from VA asylum office ,that sounds was like they want to start hearing backlog cases after January 2015.
did you hear something about this or not? or is there any new news about VA office?

    thank you

    Reply
    • I did not hear that, but we have had a few backlog cases called for interviews in the last month or so. They do not seem to be called in any particular order, but at least it is a sign that these cases are still alive. If I hear something about that, I will post it.

  29. Hi, Jason! My name is Olga and I am from Belarus. I applied for political asylum in June 2012. When I filed all documents I received the notice that my documents were accepted. After 1,5 months of waiting after filing I went to the office and it found out that my interview was supposed to be 2 weeks ago. But I didn`t receive anything – neither notice about fingerprints or the notice about interview. They told me that my interview will be rescheduled, but I am waiting for recheduling 1,5 year. Can you tell me if I hire attorney will it help ? I heard that attorney can connect directly with the Office. Thank you!

    • A good attorney is helpful for an asylum case (though a bad attorney can be very harmful – so choose carefully). It is very difficult for anyone – including an attorney to make a case go faster, but attorneys do have access to some resources that might help (like a liaison to the asylum office). I would talk to any prospective attorney to see what they would do to help. If you can’t afford a lawyer, you can communicate directly with the asylum office and ask the status of your case. If your case is in the backlog, even an attorney will have a hard time getting things moving. Good luck, Jason

  30. Dear Sir/Madam

I have a question about fee for asylum case. I mean what is the Service price of your attorney to proceed an asylum application? Preparing Application, preparing for interview, attending on interviews and etc.

and another question about will it be a problem if I will not declare in airport POE that I’m entering US as a asylum seeker, I mean if I tell in POE that I’m a tourist but then I will apply for asylum with your help?

Thanks in advance and waiting for you response

P.S. Do you have office in other US cities or only in DC ?

  32. Hi Jason,
My case is a bit complicated and would like you to help me with my questions. I am Egyptian who have been living in Australia for the past 11 years and has obtained the Australian citizenship. Can I apply for an Asylum in the states? I am in fear about my kids life from my inlaws and I can’t tell authorities in Australia about it or else I will lose my husband. I have all the proves about my case but my question is would the US help me??

    Reply
    • It will certainly be difficult to apply for asylum here if you have Australian citizenship. You will need to prove that either (1) the Australian government wants to harm you; or (2) that the Australian government will not protect you from other people who will harm you. Maybe you could also make a case that you are not “firmly resettled” in Australia – meaning that you cannot live there – because of the problems you have there. That will also be very difficult since you are a citizen of Australia. Also, by the way, you will need to show that you cannot return safely to Egypt. I wish you good luck.

  33. Dear Sir,
If my asylum application failed at USA immigration,Can I move Canada
by land border to apply my asylum with Canadian immigration ?

    Reply
    • You should talk to a Canadian attorney BEFORE you try to go to Canada. There is an agreement between Canada and the U.S. about denied asylum seekers and so you may be blocked from seeking asylum there. A Canadian lawyer can advise you about this.

  34. Dear Sir

According to the testimony of my foster mother (Mrs. Le Thi Bich – my natural aunt), in 1967 my natural mother, Mrs. Le Thi Nam, worked in room service at the U.S. military base at Phuoc Ly village, Da Nang. My mother knew and loved my father, named Michael (Called Mai Co in Vietnamese). At that time, my father was an officer in a brigade of U.S. Marines. My father’s unit provided supply and transportation for the military base at Phuoc Ly hamlet, Hoa Vang District, Da Nang City. When my mother was three months pregnant, she lost contact with my father. After I was born, my mother also went missing during the chaos of war.
Please help me to find my father.
I sincerely thank you and best wishes
    Best regards

I am a survivor of torture at the hands of the CIA on American soil. Presently in Guatemala seeking a friendly caribbean or South American country to go to for asylum. My story is documented on exopolitics.com and other site around the Planet. I have been without a home for nine years now, I am truly a stateless man and I just want a place to stop, breath and live.

  37. The situation is very delayed (I wrote about it in “The end of Asylum as We Know It). The asylum offices have hired many new people. My understanding is that once they they start working (soon), they will be process new cases and then get to the old cases (like yours) when they have time. Most people – including me – are very unhappy with this arrangement. In some offices (like here in DC), there is a way to request an earlier date. Perhaps your lawyer could try that (but it is extra work for the lawyer, so s/he might charge something for doing it).

  39. I think your blog is amazing . I would like to know your opinion about immigration judges applying discretional authority in asylum cases. Example : an applicant who does not fit exactly in the definition, he or she was nor persecuted based on race, religion, nationality, political opinion, or for being a member of a particular social group. She was a Judge who was persecuted for her judicial decisions and her asylum was granted in Ninth circuit after a horrible, painful process.
Thanks so much in advance .

    Reply
    • Thank you. I am not familiar with the case, but remember that persecution based on political opinion is the opinion that the persecutor believes you hold. So if the judge was persecuted because someone did not like her ruling, that may be imputed political opinion. Otherwise, the only thing I can really say is that asylum (like most law) is rough justice. Sometimes cases that don’t quit fit into the definition are granted; other times, cases that seem like they should be granted are denied. For the most part, I would say that our system is very good, but there are always exceptional cases…

  40. Hi , my name is Mahmoud. I am trying to apply for asylum as a Kurd from Syria and I think I may have a pretty good chance to win as I do belong to a special ethnic minor group. I have a dual citizenship from Turkey as well, but my name first and last names are spelled differently in Turkish. I want to know if I will have a chance of wining Asylum , and if it would be possible to give up my Turkish citizenship before applying so that I could only apply as a Kurds from Syria ?

  43. I am a legal immigrant with a withholding from removal type of asylum in the U.S. I’ve worked and lived in Virginia for the past 18 years always with a work permit and employment authorization. I’ve never been unemployed and still have a great job. I have two properties in this state too. So I’ve paid and I am still paying income tax, property taxes, car tax, and most importantly consider this my home. As of last year however, Virginia does not consider me a legal here even though the Federal government and USCIS does. It is not matter of just driving in Virginia, I can’t even get a walking ID, i.e. I don’t exist here but still have to pay tax. I am looking for other legal immigrants with my status to get together and file a class act law suit against this racist new law established in this state since 2010. Please let me know if you can help or join this cause.

  47. Jason, our organization (Pan-Pacific and Southeast Asian Women’s Association – part of the UN) is doing a radio/TV program on the femicide in Mexico and the activists/journalists who cover the issue and are forced to seek asylum in the US only to find that a mere 2% get it granted. We are doing this in support of these exiles. Do you think you could contribute something to this program. It will air through KPFK (part of the Pacifica Radio network) in L.A.

  48. Dear Jason Dzubow,

I’m writing with a request for advice on receiving information regarding political asylum in Mexico after fleeing the United States. Yes, a reverse from what you normally experience.

[portion removed – ed]. Over the last four years, I have been brutalized by police in Brevard County, New Orleans, San Diego County, and possibly Boulder County, CO, following a pattern of Racketeering with the resulting Obstruction of Justice.

While this was occurring, I made documentaries on the oil spill crisis in Louisiana (see “Oil Spill Crisis: Day 76” on Youtube) that are critical of Homeland Security’s lack of response and their ties to Halliburton. Since then, I have experienced extreme cyberhacking, mail fraud, a stolen passport, and disruption of telephone service, and malicious damage to my car amongst a long list of other crimes.

I asked the FBI for help, but they refused. I asked the ACLU to represent me, but they have too many cases. I have tried private legal help, but with no luck

I have just been diagnosed with MS, and am fleeing from criminal attempts initiated in Brevard County to destroy my life and my ability to provide credible witnessing to these other escalating crimes.

Can you tell me about the process, or provide a contact in the appropriate department in the Mexican government?

    All help will be appreciated,
    A. Elizabeth Guyton
