Update on the Asylum Backlog

If you’ve visited this website before, you know that I’ve written about the asylum backlog again and again… and again and again and again and again. And yet again. And once more. And probably a few other times in-between. USCIS recently released some new statistics on asylum, and so I thought I would share them here and discuss the current situation.

First off, despite the efforts of the Asylum Division, the backlog continues to grow. In January 2015, the total number of backlogged cases was 76,446. By the end of March 2015, there were 82,175 backlogged asylum cases nationwide. The numbers have only increased since then.

The main cause of the backlog has been large numbers of people–mostly young people–coming to the United States from Central America. These young people are detained at the border and receive a credible fear interview, which is an initial assessment of eligibility for asylum. If they pass the credible fear interview, their case is referred to an Immigration Court, which then fully reviews their asylum application. The credible fear interviews are conducted by Asylum Officers, and because they are detained at government expense, the young people are given priority over other (non-detained) asylum seekers. Because the Asylum Division must devote resources to these credible fear interviews, they have been unable to keep up with the more traditional asylum cases. Hence, the backlog.

I keep expecting the number of young people coming here to wane, but so far that has not been the case. Indeed, the number of people coming from Central America this year is nearly identical to the numbers we saw last year. And given that summer is traditionally a busier time for migration from Central America, we can expect more young people to arrive at our border in the next few months. Thus, it seems likely that the backlogged cases will keep piling up.

According to the latest statistics, the least backlogged offices are Houston (3,971 backlogged cases), Arlington (5,791), and Chicago (6,485). The most backlogged office is Los Angeles (17,042), followed by Newark (14,924), New York (13,568), Miami (11,366), and San Francisco (9,028). Wait times in these offices roughly correlate with the number of cases backlogged, so Houston is currently the fastest office and Los Angeles is the slowest.

Of course, obtaining a (relatively) quick interview date is of little value if the case is denied. In terms of grant rates, the fastest offices are not necessarily the most likely to grant asylum. Although the statistics on this vary, the offices in Chicago, Houston, Miami, Newark, and New York all grant asylum less than 33% of the time. Arlington and Los Angeles grant about 50% of their cases, and San Francisco grants over 60% of its cases.

So what is the Asylum Division doing to address the backlog?

For one thing, they have been hiring more Asylum Officers. Since the backlog began in 2013, the number of staff members has increased by 90% and they continue to hire and train more officers. It appears that the Asylum Division will continue to add new officers through 2016. So if–and it is a big if–we see a drop in credible fear interviews at the border, the asylum offices should be well positioned to make some progress on the backlog.

The Asylum Division is also making an effort to keep the public more informed about the backlog. For some months now, there has been discussion about providing more information about processing times at the different asylum offices (for example, the Arlington, Virginia office is currently interviewing cases from July 2013). Because workloads are unpredictable, the asylum offices do not know when they will interview an individual case, but they do know which cases they are processing now. By posting this information, at least asylum seekers will have some idea about where they stand in the queue (the Department of State has a similar system for family- and employment-based immigration visas).

The asylum offices have also created some very limited ways to expedite cases. I have discussed those here.

As an advocate for asylum seekers, of course I believe that more should be done. Most importantly, I would like to see the asylum offices give higher priority to people separated from their immediate relatives. I would also like to see more resources devoted to processing I-730 petitions, which allow approved asylum seekers to bring their spouses and children to the U.S. Also, given that asylum cases are moving slowly, I would like to see USCIS issue work permits (EADs) for two or more years, instead of just one year. Finally, I would like to see responsibility for credible fear interviews moved from the Asylum Division to a separate unit or–better yet–the elimination of credible fear interviews altogether (CFIs are basically rubber stamps and thus a waste of resources; it would be better if such cases were adjudicated in the first instance by an Immigration Judge).

The Asylum Division is faced with a very difficult–if not impossible–task: To continue adjudicating asylum cases while dealing with an unpredictable and overwhelming number of credible fear cases, all the while, with a hostile Congress looking for excuses to reduce asylum protections. For the sake of our asylum system and those who need protection, I hope they can navigate these treacherous waters.

    I applied for asylum last year in NY state. Now I moved to another state. I informed them that I have moved to a different address. Will they automatically send my documents to the nearby asylum office or will my files still be processed in NY state?.

    • If your move takes you into the jurisdiction of a new asylum office, your case should be moved automatically.

Hello Jason, first thank you for your posts, I am one of the backlog cases in Chicago, I changed my address during this time but stayed with Chicago asylum office location , Does this have any effect on my turn for the interview ? I.e received receipt on Oct 2013, changed address on March 2014..which of these dates do you think going to be my turn for the interview ?

    • Your case is in the backlog along with everyone else. They are currently interviewing people who filed in August 2013.

    • You can apply for the DV lottery, but if you win, it may require you to leave the US and return – for that, you should hire a lawyer.

    I applied for Asylum on September 2014 in New York. I have no receive interview date. Maybe it will take times because of backlog. Currently I am working a company and company management said, they will help me and apply for sponsorship. So I can get quickly the green card and bring my family in USA ASAP. Is it possible to make two cash in same time Asylum and sponsorship? Do you think I will go for sponsorship case? I will highly appreciate your advice.

    • You should be able to do both, but there are some possible problems. You will need a lawyer for the sponsorship, so you have to tell him/her about your asylum case and your status here. The lawyer should be able to guide you.

  7. Hi Jason, I hope you are doing alright. My question today is about my I-730, which is already approved. I’m in U.S., and I received my approval notice without an I-94. Wherever I go , I’m asked to bring an I-94; however I don’t have one. What would be the next step for me to get it? I was approved by TSC, and I really need an I-94. I called USCIS. Surprisingly, they told me they don’t issue one. I have seen many people getting their I-94 with the approval

    • I am not sure about that. Maybe try contacting the asylum office. There is also a form I-102, which is the normal way to replace a lost I-94 – However, I do not think that applies to you. Maybe the approved I-730 + the work permit is all the give, but I also thought they issued an I-94 when the I-730 is approved.

    I applied for asylum since July 2014 and didn’t get interview till now.I have documents illustrate that my Dad was working for US army (he was supplying the army with stuffs )in my native country,so do these documents may help me to get an interview or give me any priority or any chance to grantee the residency?

    hope u oke thank u for a great job i have an issue there soo many Ugandan who come and seek asylum claiming to be LGBT members and i know some of them i wanted to report them to the uscis because i know for sure there not LGBT members wont it affect my pending case pliz because these people ruin our reputations. am willing to give the uscis address if they can use the investigators to find out that hat i am saying is the truth

    • I do not think it will affect your case to report people, but I do not know a specific address for reporting such issues.

    • If you move to an area with a different asylum office, and you have not yet received your work permit, the move could prevent you from getting the work permit.

    And also if i transfered my file from los angels will dat affect my interview dates

    • If you have made a permanent move to Boston, you should file a change of address form (AR-11) and your case will be transferred to Boston. It is also slow there, but probably faster than LA, which is the slowest office in the country. As for the Social Security, I believe you can apply at any office in the US. Take care, Jason

        • We drop it in person to the asylum office where your case is pending. You can also mail it to them. They will not send you a confirmation, but if your case moves to another office, the asylum clock will stop and the case will be moved.

  14. I just want to thank you “Jason” for your good website and your nice and informative comments. I always follow to know about updates in Asylum offices. It is so useful. You really help people and we pray for you, may god reward you. My asylum application was received by San Francisco Asylum office in 09-feb-2015. It seems like I should wait at least 6 more months for the interview date. I applied for the work permit a month ago and wish I will get it soon.

    I am on removal proceeding due to denied asylum application. I have lived here since 2003. Is it possible to apply cancellation of removal for the last resort ? I have one US citizen kid who receives special education at school. No criminal/conviction history, paying taxes with ITIN but use phony SSN for working purposes only. Is it will be a ground for denial related to “good moral character” requirement ?

    • If you have the 10 years and the qualifying relative, you may qualify for Cancellation of Removal. You really do need a lawyer to assist with such a case, as they are very tricky. Good luck, Jason

  20. Thank you Jason for your great work. Finally my case got approved after a year with recommended approval. You recommend me to try the ombudsman and they do help me. It took four months after I request the ombudsman office. I am now happy and preparing petition for my families back home. Any recommendation from you would help if any to fasten the petition process, anything that i could be careful not to make other delay. I and my family have been suffering a lot by the long process. Do you know the situation now in this process, how long is the average time for the petition process. I have been highly victimized by the backlog and then the delay after the interview, do you think writing and sending a letter that explains how my case was delayed for long with the petition application will help or at least do not harm the petition?

    • The processing time for I-730 is variable, but usually they are approved in 4 to 8 months. Then the embassy has to process the cases, which takes a few more months. Sometimes there are delays, but usually not nearly as bad as the delays with asylum cases. While I think they should give priority to family members of people whose cases were delayed, they do not, and I do not think writing a letter about that will do much to help. But I also do not think it will hurt, so you can try. If it is too slow, you can contact the Ombudsman again or your congressman. Good luck and congrats on finally getting the approval, Jason

        • You need to submit all your evidence prior to the interview. You will have to check with your local asylum office, but at my office (Arlington, Virginia), we must submit documents at least one week in advance; otherwise, they will not accept the documents. Good luck, Jason

    • I am not sure I understand. The pending cases include only those that have not yet been interviewed. They do not include cases where the person was interviewed but has not yet received a decision.

  27. i am in Pakistan and i want come to USA and apply for asylum there,My country is the 8th most dangerous country to live and because of this the economic conditions are very poor and the bank interest rate about 8% per annum its difficult to return the bank loans so i would like to know where should i land in america and apply for asylum

    • Poor economic conditions are not a basis for asylum. Perhaps you should contact a lawyer in the US to see whether you have a case for asylum before you come here. As for where to apply, I cannot make a recommendation because there are advantages and disadvantages of applying in different places. Good luck, Jason

    Recently I applied for asylum and yesterday I got acknowledgment of receipt from asylum office Newark NJ with A number on it. My spouse is the rider/derivative applicant. How do we know his A number since the receipt is showing only my A number ? Is he going to get another acknowledgement receipt from himself ?.

    Another question, how to know the asylum clock calculation ? I called 1-800-898-7180, but my A number did not match any case on the immigration court records.

    • For cases before the asylum office, the phone number does not help. You just have to calculate yourself based on the “received” date on the receipt. Probably you will receive a fingerprint notice for you and for your spouse, and that notice will have your spouses A number.

        Thanks for your work. You are doing great. I have a question. I did not know that my A number would be different to the my spouse. Therefore we applied for the EAD with the same A number, and we received it perfectly. Could this bring me any problems in the future? What A number should I use in next applications?

        • Hmmm. I think when you apply to renew you will need to try to fix this by sending the correct A number and explaining the error. You’d probably do better to consult an attorney about the specifics of the case to see whether he or she can help you.

    • No one can really predict when the interview will be, as it depends on how many people enter the system. Also, some offices are faster than others.

  31. These days i guess asylum offices across the US have stoped working other than piling applications and increase the size of our mysterious backlog. Sometimes i feel like i am the most useless person who prosecuted in my own country and trashed somewhere else to never found a place to live with my lovely wife and son again in this life. In the eyes of God, we were begging for shelter from the US gov, though it seems forver to deal with our cases. In this developed world all the doors are closed to access information about asylum, status of application….. No one cares i guess. I know we have no right to request since we are pledging a a place to live. Its really painful to live apart with loved ones for such a long time. I wish those who decides on our cases can feel our pain. I sometime expect miracle like administrative action on all of the backlogged cases either to grant or deny their application. Its seems i vent to much of my pain. Thank you Jason for your blog, its the only that i can meet my kind of desperate people.

    • I do not know if it is any comfort, but many people are in the same situation. It is very sad. I have met many people who work for the asylum division in the government, and they generally do care and they are trying to make it better, but it is difficult due to the large number of asylum applicants.     Thank you for the info its a relief to hear a bit… I have pending case at Arlington office since the beginning of Oct 2013, is it possible to estimate my interview date?? I heard they were doing the interview fast but now they seem so slow to move out of August 2013 do u have any info on this??

    Thanks for your information. I went to Newark office last week. I have been told that they are interviewing cases from April ’13. They are forecasting to interview cases from May and June 2013 in August. And July and August of 2013 in September, and so on. They will be able to interview cases of January ’14 by the beginning of 2016. BOZ, POM and STA are interviewing October, October and July of 2012 respectively.
    This time the response was an official letter signed by the Office Director. I hope this information is beneficial to all readers of this page. Thanks again. James.

        • We cannot predict how long you will wait, unfortunately. Once you file for the work permit, it usually takes between 1 and 3 months to get it.

          • My clients generally apply for the SSN once they have the work permit. If you want to apply sooner, talk to the Social Security Office. As for the work permit, you can do it on your own or use a lawyer – it is up to you.

    • The only info I have on LA is that they are interviewing cases filed in 2012 – I do not have the month. They are currently the slowest office in the US.

    • I think they are just not being precise. I suppose pending could mean “interviewed but no decision” whereas backlogged would be “not yet interviewed,” but I do not think these are terms of art, and I think they are just being casual. The bottom line is, you do not yet have a decision.

    just 1 question: Is there any problem in the Arlington asylum office? it seems that they get stacked again (it has been a while since you updated as they start interviewing august 2013 and still they are in august 2013). My case was pending since the beginning of September 2013 and actually I got interviewed and got recommended approval but i am just to celebrate one year of my recommended approval date with out the final decision and was thinking an other hope; if they start the September applications they may finalize the already interviewed ones. I have tried almost all options but still no hint, i don’t know what is going on there. Thanks.

    • They are still interviewing August 2013 cases, but I think this has nothing to do with the delay in your case. There are two separate problems – delay before the interview (for all applicants) and delay after the interview (for some people, usually related to security checks). There is very little you can do about the post-interview delay. Maybe try the Ombudsman. Unfortunately, we have had people with recommended approval waiting up to two years (and counting). This is pretty rare, and so hopefully you will have a final decision soon. Good luck, Jason

    I applied for Asylum January, it is almost six months passed, but didn’t get any call for interview. Recently I have applied for EAD and waiting for EAD decision. I am frustrated due to multiple reasons,
    1. My attorney ripped me off, he took full fee in advance and submitted my case after long delay.
    2. He is reluctant to reply to my email.
    3. He asks me for more money to submit EAD and I submitted in summer vacation, which make more delay in the decision.

    I want to email to USCUS office for my case update, could you please guide me, does it make any problem in my case in the future or they will become irritated by email inquiry?

    • Nobody who filed in January 2015 has received an interview yet. The fastest office is Texas, and they are interviewing cases filed in about April 2014. I wrote about some ideas to make the process faster on February 26, 2015, but in general, there is little to be done. I do not think it will harm your case to contact the asylum office. However, it is a good idea to be on the same page as your lawyer. Based on what you told me, I do not see any major problems with what he has done, but if you do not trust him, you might want to find a new lawyer. Also, if you paid for all the work up front and you fire the lawyer, you might be entitled to a refund.

    • They are about the same – New York is interviewing about March 201 and Miami is interviewing February 2013.

    At the begining of July 2015 we got a recommended approval. my questions are
    1. how long it takes to get the final grant letter
    2. is the time with recommended approval counted to wards the one year period for Green Card ? or it starts to count after the final grant ?

    • There is no time frame – we have seen where it takes a few days, and we have one case where it took over two years (and counting). Most of the recommended approvals receive a final approval in a few months. Unfortunately, the time does not count towards getting a green card. Good luck, Jason

    I would like to know if asylum in pending status can go to Nepal with the TPS or not.

    • That depends. If you are from Nepal and go there, it will probably cause big problems for your asylum case. Also, just because you have TPS does not mean you can leave the US and re-enter. You need to talk to a lawyer before you travel outside the US. Take care, Jason

    I applied for asylum on April 2013 with the Arlington office as I was living in Georgia. I moved To Houston in January 2014 for school and I notified them of my change of address which they responded to. I wrote to them after that to know which asylum office was now handling my case but no response. I was never interviewed and I don’t know which office is handling my case and what to do .

    • Most likely, the case was transferred to Houston. You can email the Houston office to ask.

    I was interviewed in Chicago asylum office in 8/2013 but still no decision has been made. My question is , are they just interviewing cases filed in May 2013 or they are making decisions for old cases too? If they are , do you know what month cases are they processing now?

    • It is a long delay. I suggest you contact them again about your case. You might also contact the DHS Ombudsman for more help (I wrote a post with relevant links on February 26, 2015). Good luck, Jason

      • Many offices are currently interviewing cases filed two years ago. In our local office, they have already interviewed many of the 2014 cases, so we are hopefully that they will start moving through the backlog more quickly and that newly-filed cases will not wait for two years. We hope.
